In the 10 years since the enactment of the Americans with Disabilities Act ("ADA"), retailers across the country have tried to ensure that their existing and newly constructed stores comply with the ADA and its "building code," the ADA Accessibility Guidelines ("ADAAG"). Yet, the flood of ADA litigation continues, even with respect to stores constructed since the enactment of the ADA.
